2.0 PURPOSE: PRIVACY POLICY

This Privacy Policy (herein referred to as “Policy”) explains how PATTS. LLC (herein referred to as the “Company,”, “we”, “our” and “us”) processes Personal Data collected from you (herein referred to as the “User”) as a Controller.

If you are a User located in the European Union (EU), as a User of this Website you are considered notified regarding:

  • the management of Personal Data in accordance with Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data; and

  • on the transmission of Personal Data, and repealing Directive 95/46/EC (hereinafter: GDPR).

3.0 DEFINITIONS.

3.3 “Policy” shall mean this Privacy Policy document, the contents of the document and the stipulations of the Privacy Policy.

3.2 “User” means the natural or legal person who is active on the Website, has requested Service(s) of PATTS. LLC or has agreed to this Privacy Policy or the Website Terms & Condition Agreement.

3.3 “Terms” means the binding contract between the Company and User that governs the User's access and use of the Website and use of the Service(s).

3.4 “Service(s)” means those offered by the Company, which include Service(s) but not limited to those mentioned on the Website (www.pattsllc.com).

3.5 “Company” shall include all affiliates, subsidiaries, and related companies of PATTS. LLC.

3.6 “processing”, “process”, “processed” means activities such as collection, storage, use, consultation, and transmission of your personal data.

5.0 DATA COLLECTION.

5.1 The Legal Basis. The legal basis for the collection of Personal Data with the User’s consent includes:

5.1.1 Purpose. Personal Data is collected to enhance the Website experience, to comply with a legal obligation, to address the User’s request(s) for Service(s), to potentially enter into an agreement or engage with the User or to communicate with the User. Further, enhancing the Website experience may include usage of the Service(s), the pages visited on the Website, search history, other viewed content and analytics.

5.2 User’s Consent Withdrawal or Refusal.  In the following instances, the Company will not respond to the requests made by the User nor provide Service(s):

    a. The User can withdraw their consent or choose not to provide Personal Data (see Clause 8.0 CONTACT DETAILS of this 

        document); or

    b. The incomplete, inconsistent or meaningless data provided to the Company is regarded by the Controller as the User’s refusal to 

        consent to the collection and processing of Personal Data.

6.0 PROCESSING OF PERSONAL DATA.

6.1 The Legal Basis. The legal basis for the processing of Personal Data with the User’s consent includes:

  • The Company processes the User’s Personal Data to enhance the web site experience.

  • The Company will generally collect Personal Data from Users only where it needs to create a contract with the User, where the collection and processing are in the Company’s legitimate interests and not overridden by the User’s data protection interests or fundamental rights and freedoms, or where the Company has the User’s consent. In some cases, the Company may also have a legal obligation to collect Personal Data from the User.

  • If the Company processes Personal Data with the User’s consent, the User may withdraw their consent at any time (see Section 8.0 CONTACT DETAILS of this document).

7.0 SHARING OF PERSONAL DATA.

Personal Data is accessed by the Controller and their Third-Party service providers exclusively for the purpose of performing the tasks facilitating engagement with the User.

7.1 Reasons for Sharing Personal Data. The User acknowledges that the Company may share the User’s Personal Data with its group companies and Third-Party service providers for the following reason(s):

  • For the Company to offer the User the Company’s Service(s) and/or send information, updates or communications about the Service(s).

  • When the Company processes the User’s order, Personal Data is sent to Third-Party service providers when the User purchases Service(s) on the Website and the Company may use the resulting information from credit reference agencies to prevent fraudulent purchases.

  • When the User submits a contact request via the Website, which routes the User’s email to the Company via the Third-Party service provider and is stored by the Third-Party service provider.

  • When the User is active on the Website, Personal Data is shared with the Third-Party apps (see Section 5.0 DATA COLLECTION of this policy) to enhance the Website experience, aggregate the data or offer Company Service(s) to the User.

8.0 RETENTION OF PERSONAL DATA.

Company retains the Personal Data when an ongoing legitimate business requires retention of such Personal Data. In the absence of a need to retain Personal Data, the Company will either delete or aggregate it. If this is not possible, the Company will securely store your Personal Data and isolate it from any further processing until it is deleted.

 

9.0 SECURITY OF PERSONAL DATA.

The Company uses appropriate technical and organizational measures to protect the Personal Data it collects and processes. These measures are designed to provide a high level of security appropriate to the risk of processing the User’s Personal Data. If you are a User and have any concerns about the security of your Personal Data, please contact the Company or Third-Party service providers immediately.

 

10.0 MODIFICATION.

The Company keeps this Privacy Policy under regular review and may update Website at any time. This Privacy Policy may be amended at any time, and the User shall be notified only if there are material changes to this Privacy Policy.

11.0 ARBITRATION.

In the event of any dispute arising in and out of this Privacy Policy between the Company and the User, it shall be first addressed by arbitration. A mutually agreed upon Arbitrator shall be appointed. The Arbitration shall be in the location complying with Section 12.0 of this Privacy Policy. If an amiable resolution is reached between the Company and the User during arbitration, the arbitrators' decision shall be final and binding on each.

The Company and the User agree to cooperate to seek from the arbitrator protection for any confidential, proprietary, trade secret, or otherwise sensitive information, documents, testimony, and/or other materials that might be exchanged or the subject of discovery in the arbitration. Company and the User agree to seek such protection before any such information, documents, testimony, and/or materials are exchanged or otherwise become the subject of discovery in the arbitration.

 

12.0 CHOICE OF LAW.

12.1 Choice of Law. The laws of the state of Texas govern this Privacy Policy (without giving effect to its conflicts of law principles).

12.2 Choice of Forum. The Controller and the User consent to the personal jurisdiction of the state and federal courts in Dallas County, Texas.

 

13.0 HEADINGS.

The descriptive headings of the sections and subsections of this agreement are for convenience only, and do not affect this agreement's construction or interpretation.

 

14.0 COOKIES Questions & Answers (high-level only).

14.1. Cookies. The User’s browser might store cookies when vising the Website (www.pattsllc.com). The Company and Third-Party service providers may use tools to collect and store data (in your browser or on your device) when visiting the Website. These could include cookies and similar technologies. In addition, these technologies may recognize network identifications such as the IP address.

14.2. Reasons for Cookies. Cookies facilitate the Website through navigation, increased downloading speeds, introduce improvements based on past experiences, upload content suited to the User’s needs and enhance the Website experience.
